1. Definitions

"Service" refers to Blogauto.ai, the AI-powered automated blog content generation and publishing platform.
"Company", "We", "Us" refers to Webcomp Digitex Pvt. Ltd.
"User", "You" refers to any individual or entity using the Service.
"Content" refers to any text, images, or other material generated using the Service.
"Credits" refers to the consumable units used to generate content on the platform.

2. Acceptance of Terms

By accessing or using Blogauto.ai, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be legally bound by them. If you are using the Service on behalf of a company or organization, you represent that you have authority to bind that entity.

3. AI-Generated Content - Critical Disclaimer

Blogauto.ai uses artificial intelligence models (including but not limited to Anthropic Claude) to generate content. You acknowledge and irrevocably agree to the following:

• No Accuracy Guarantee: AI-generated content may contain factual inaccuracies, outdated information, errors, hallucinations, or unverified claims. We make no warranty, express or implied, about the accuracy, completeness, or reliability of any generated content.
• Your Responsibility to Review: You are solely and entirely responsible for reviewing, fact-checking, editing, and approving all content before publishing it on any website or platform.
• No Professional Advice: Content generated through Blogauto.ai does not constitute legal, medical, financial, investment, or any other form of professional advice. Do not publish or rely on AI-generated content as a substitute for qualified professional consultation.
• Image Imperfections: AI-generated images are produced through automated prompt systems. Images may contain visual artifacts, anatomical inaccuracies, distortions, or unintended elements inherent to current AI image generation technology. We do not guarantee the accuracy, appropriateness, or visual quality of generated images.
• SEO Results Not Guaranteed: While our system is designed with SEO best practices, we make no guarantee of specific search engine rankings, traffic improvements, or business outcomes resulting from published content.

4. User Accounts

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately at support@blogauto.ai if you suspect unauthorized access. We reserve the right to terminate accounts that provide false information or violate these Terms.

5. Credits & Payments

• Credits are consumed per article generated. Credits are deducted only upon successful content generation and publication.
• All payments are processed securely via Razorpay. Prices shown for Indian users are in INR and are inclusive of 18% GST.
• Credits are non-refundable once consumed. Unused credits from a cancelled plan will remain available until expiry.
• Credits expire after 12 months of account inactivity.
• We reserve the right to modify pricing at any time with 30 days prior notice.
• Top-up credits are available for purchase at any time, independent of subscription plans.

6. Refund Policy

All sales are final. Credits and subscriptions are non-refundable except where required by applicable law. If you believe you were charged in error, contact support@blogauto.ai within 7 days of the charge and we will review on a case-by-case basis at our sole discretion.

7. Intellectual Property

You retain full ownership of the content generated through your account. Webcomp Digitex Pvt. Ltd. claims no intellectual property rights over your generated content. The Blogauto.ai platform, its codebase, design, branding, and underlying technology remain the exclusive property of Webcomp Digitex Pvt. Ltd.

8. Prohibited Uses

You agree not to use Blogauto.ai to generate or publish:

• Spam, malware, phishing, or deceptive content
• Content that infringes third-party intellectual property rights
• Defamatory, harassing, or discriminatory content
• Medical, legal, or financial advice intended to be relied upon without professional review
• Content violating applicable laws in your jurisdiction
• Content designed to manipulate search engines in ways that violate their guidelines

9. Third-Party Services

The Service integrates with third-party platforms including WordPress, Anthropic Claude API, Razorpay, and SerpApi. We are not responsible for the availability, performance, or policies of these third-party services. Your use of connected platforms is subject to their respective terms of service.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Webcomp Digitex Pvt. Ltd., its directors, employees, agents, and licensors shall not be liable for any:

• Indirect, incidental, special, punitive, or consequential damages
• Loss of revenue, profits, data, or business opportunities
• Reputational damage arising from published AI-generated content
• Third-party claims related to content published using the Service
• Damages arising from inaccuracies in AI-generated content or images
• Service interruptions, downtime, or data loss

Our maximum aggregate liability is limited to the total amount paid by you in the 3 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Webcomp Digitex Pvt. Ltd. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) any content generated and published through your account; (c) your violation of these Terms; (d) your violation of any third-party rights including intellectual property rights; or (e) any claim that content published via your account caused harm to a third party.

12. Warranty Disclaimer

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted service. We do not warrant that the Service will be error-free, secure, or available at all times.

13. Account Termination

We reserve the right to suspend or terminate your account immediately, without prior notice, if you breach these Terms, engage in fraudulent activity, or if we are required to do so by law. Upon termination, your right to use the Service ceases immediately. Unused credits are forfeited upon termination for cause.

14. Modifications to Service & Terms

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We may update these Terms periodically. Material changes will be communicated via email or in-app notification at least 15 days before taking effect. Continued use of the Service after changes constitutes acceptance of the revised Terms.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of competent courts in Pune, Maharashtra, India.
